IMG_0344I have been receiving several phone calls and emails this week about repairs to roads that are classified as private.  A private road can have public access but not have County or City maintenance.  In neighborhoods in the rural areas within the city limits of City of Norman and Oklahoma City that did not build their road to city specifications when the neighborhood was developed the roads are considered private.  These roads are shared ownership of the land owners and therefore they are responsible for maintaining.

However, there are options.  Oklahoma City has a program called “Special Assessment District.”  For the a complete process and all requirements, refer to Oklahoma State Statutes Title 11, Cities and Towns Improvement District Act, Article 39.

Here are a few specifics on the Road Special Assessment District.

1 . Fifty percent of the property owners need to sign a petition in favor of creating an assessment district. The petition(s) and a check in the amount of $3,400 shall be delivered to the City Clerk.

2. City Council may consider a resolution directing the City Engineer to prepare a description of the property to be included in the assessment district, an assessment plat, preliminary plans for the proposed improvements and a total cost estimate.

3. Once the City Clerk has received the City Engineer’s report, a resolution
